Terms and conditions of service
SUBJECT
The following terms and conditions of purchase (hereinafter, the "Terms and Conditions") govern the contractual relationship between the Customer and www.emmimarket.com. as identified below (hereinafter referred to as "emmimarket.com"), and together with the purchase prices published on the website and in force at the time of purchase, constitute the full set of provisions applicable to the contract.
SCOPE OF APPLICATION AND CONCLUSION OF THE CONTRACT
The online offer and sale of products constitute a distance contract governed by articles 45 et seq. of Legislative Decree 6 September 2005 n. 206 ("Consumer Code") and by Legislative Decree 9 April 2003, n. 70, containing the regulations on e-commerce.
The Customer is required to carefully read these Terms and Conditions.
The applicable Terms and Conditions are those in force on the date of transmission of the purchase order.
They may be modified, but any changes will be effective between the parties from the moment of their publication on the Site and will only apply to orders placed after the publication.
These Terms and Conditions are applicable only to the Italian territory.

The advertised price of products and services, always stated in euros, includes taxes, delivery costs, and those related to the payment methods used.
All prices indicated on the site include VAT. Prices and availabilities indicated in this catalog are subject to stock depletion and are subject to change due to market or other reasons. Discounts, vouchers, and promotions are never cumulative. The images shown on the website are purely indicative and may differ significantly from the product actually available. Sometimes, due to changes in packaging by manufacturing companies, images, which for technical reasons cannot be replaced in real time, may be obsolete.

INFORMATION DIRECTLY RELATED TO THE CONCLUSION OF THE CONTRACT
In accordance with Legislative Decree 9 April 2003, n. 70 concerning provisions on electronic commerce, we inform the Customer that:
• to purchase one or more Products on the Site, the Customer must complete an electronic order form and send it electronically, following the instructions that will appear from time to time
• before proceeding with the transmission of the order form, the Customer can identify and correct any data entry errors by following the instructions indicated from time to time on the Site and which will accompany the various stages of the purchase and accept the General Terms and Conditions of Sale;
• once the order form is registered, an email "Order Registration Confirmation" containing a summary of the order will be sent to the Customer at the email address indicated. The order form will be stored in the database for the time necessary for its execution and, in any case, within the legal terms.
• The language available to customers for the conclusion of the contract is Italian.

INVOICING METHODS
Invoicing is carried out differently depending on the type of customer: Consumers and/or businesses
DELIVERY / COLLECTION TERMS
Delivery will take place within 30 days from the order date, unless a different term has been agreed between the parties.
The Customer acknowledges that the collection of the Product is a specific obligation arising from the purchase contract. In the event of non-delivery due to the absence of the recipient at the address specified in the order form, after two unsuccessful delivery attempts, the package will go "into storage". In the event of non-collection of the Product within five working days from the first delivery attempt, the contract will be considered terminated and the purchase order consequently canceled pursuant to art. 1456 c.c. Once the contract is terminated, the total amount eventually paid by the Customer will be refunded, deducting the costs of the unsuccessful Product delivery and the return costs.
The termination of the contract and the refund amount will be communicated to the Customer via e-mail.
TRANSFER OF RISK
The risk of loss or damage to the Products for reasons not attributable to emmimarket.com is transferred to the Consumer at the moment when the latter or a third party designated by him and different from the carrier, materially takes possession of the same, unless the carrier was chosen by the Consumer, unless the choice was proposed by emmimarket.com
COMPLAINTS
For any complaint, including any reports of Defects of conformity as described above, the Consumer can contact emmimarket.com at the contacts indicated above.
COMPETENT COURT AND APPLICABLE LAW
For any dispute however originating from or connected to or deriving from these Terms and Conditions, the Ordinary Judicial Authority of Treviso will have exclusive jurisdiction. The applicable law is Italian law.
CONSENT FORMULA
Having acquired the above information, the user declares to consent to the processing of the data provided as described above.
Obligations of the Consumer
The Consumer shall bear the shipping costs for the return of the received products, which must be shipped within fourteen days from the date on which they communicated their decision to withdraw from the contract (the deadline is met if the Consumer returns the goods before the expiration of the fourteen-day period).
The substantial integrity of the goods is an essential condition for exercising the Right of Withdrawal. The Product must therefore be stored with normal diligence and returned intact, complete in all its parts, perfectly functional, and free from signs of wear or dirt.
The withdrawal period ends 14 (fourteen) days after receipt of the goods or, in the case of services, from the conclusion of the contract. Within this period, the Customer must communicate to emmimarket.com their intention to withdraw from the contract

Disclaimer
1. The main objective is to ensure that the order reaches its destination as soon as possible. However, customers and/or recipients are responsible, at the time of purchase, for the products received and the delivery details provided (always check that they are correct).
2. We cannot assume any responsibility for any losses incurred by the customer or the recipient, in terms of non-refundable transport costs and/or additional costs for the delivery of the goods or their replacement.
Refunds are possible, by the shipper, with insured shipping. The initial shipping costs and import duties are not refundable. The same applies to the costs incurred for returns and for the insurance of the item, unless otherwise agreed.
